Hello, I'm new here; I believe I'm caught in the middle of work comp. Nightmare! I was injured at work in November of 07-work comp. Dr diagnosed me with a Lumbar Strain, In mid January I continued to have pain and an MRI was done. It showed broad based disc protrusion into the far right lateral and far left lateral L4-5 and a broad based right protrusion, right lateral at L2-3. I continued to work on the floor of a very dangerous Psy. ward, with restrictions: push, pull carry no more than ten pounds; stand, sit, walk as tolerated. I did P.T, chiro and two injections with no improvement. In February, Dr. reduced restrictions to 5-pound lifts, carry push, pull, and recommended office work. My employer said according to work well guidelines they couldn't accommodate these restrictions. I was on work comp for four weeks, In March I went back to OCC, health doctor, and he kept restrictions the same - NO changes. My employer says " we can accommodate you now, we are desperate for help". I worked part of one day, was unable to keep restrictions of walk, stand, sit as tolerated (I was on my feet three hours straight without sitting down), I left work and ended up in the ER with a pinched nerve, numbness in right leg. I had to see the work comp. Dr. the next day, he says,” You’re employer is pressuring me to give you an impairment rating today and get this thing over and done with, they don’t want to pay any more of your bills!! Then he says, “I want to send you to a rehab specialist for some intense therapy to strengthen your trunk (He said the therapy would take 3-6 months. I go see this other Doc, and when I get a copy of his report he states right in there that he finds my exam creditable, no mention of any treatment, I was sent to him for a medical exam to try to discredit my claims!! Now my Occ health doc says he’s done with my case and Is sending me for a FCE , My question is do I have to agree to this 2 day event and how will it effect my future claims? His nurse says the exam is for my employer so they can decide if I can return to my job?? sounds fishy to me, I guess I have trust in no one at this point, as I have been lied to at every turn. Any advice would be helpful…. THANKS

Sorry, but I forgot in my earlier post to tell you that my work comp. insurance company stopped my weekley benefits after my employer refused to honor the doc's restrictions, they insist that they can accomidate the 5lb. limit and the walk, stand, sit as tolerateed, they don't want to honor his recommened office work. I finally had to file FMLA papers to protect my job and health insurance (unpaid while I recover from a work-related injury) Has this ever happened to anyone else??
