And then what...

What Happens Next??? Posted At 10:47:49 01/03/2001
I'm wondering what happens after all the appeals are done and the case is over. I'm permanently injured and going on SSA, it may sound silly but what happens when the court is done. Do you sign off Work Comp? Do you still have IME's? Or do they write you off and move on to the next victim?

Which state do you live in? If Oregon, I can give you some info as I have been a Permanent and Total Disability for several years.

In Oregon the insurers can re-examine you and do home meetings every year or two, in my case it's been every two years for a home meeting with an insurance company investigator.

I still receive a monthly check from the insurer but it's offset by Social Security to a certain amount. If you have an attorney, they should be able to answer your questions for you. Also, the state's Comp Ombudsman is an excellent source of information. Send them an e-mail or give them a call on the toll-free number. . . .it's definitely worth your time and effort.

Please tell me more about these home meetings, and what they do. I don't want those people anywhere around my house. If they want to examine me they can set up a time at my doctors office, or with my attorney I don't want them involved in what I have left of a life.
At what % is the SSA offset, does it reduce it or do you have a allowable
amount.
I do live in Oregon and this is all greek to me. Please fill me in and let me know all the great things I'm in for. Thanks for your help Old Timer...

The investigator usually checks the current activity levels. They will
want to know if the worker drives a vehicle, when they last saw the
doctor. He will ask what hobbies the worker has. What they do all
day. He will ask about medication the worker takes on a daily
basis. The main reason for the visit is to determine if the activity
level has changed. Sometimes the insurance company has
information that looks like the worker is performing daily activities
at a higher level than when the PTD was granted. Again keep in
mind that the law allows them to investigate every 2 years or more
often if they have information showing a change in the status.
