Injured workers and concerned Oregonians,

A fraction in our legislature is at it again. They know that workers comp's exclusive remedy provision violates our state Constitution and our state Supreme Court will probably (after 90 years) state so in the Smothers case at time now. Exclusive remedy is unconstitutional in the following areas:

Oregon Constitution, Article 1 - Bill of Rights

Section 10. Administration of justice.
No court shall be secret, but justice shall be administered openly and without purchase, completely and without delay, and every man shall have remedy by due course of law for injury done him in his person, property, or reputation.

Section 20. Equality of privileges and immunities of citizens.
No law shall be passed granting to any citizen or class of citizens privileges, or immunities, which, upon the same terms, shall not equally belong to all citizens.

To make the most likely Smothers decision "NULL" (the Court could take 5-12 years to rule on SJR 36), these business and insurance company hacks in the Oregon Senate have proposed SJR 36. This bill would add an amendment to Oregon's Constitution relating to remedies for work-related injuries.

It makes remedies available under workers' compensation statutes exclusive remedy for all work-related injuries. It refers the proposed amendment to people for their approval or rejection at the next regular general election.

It is critical that this be stopped before passage. Insurance companies will go all out in an election to deceive voters. We've all seen video footage on tv shows of private detective's supposedly exposing the frauds. They don't advertise that various state studies and insurance company data puts claimant fraud at 1-2% of claims while employer fraud (along with insurance campany fraud) runs rampant.

It is time to bear pressure on our legislature so they legislate for Oregon's average citizens. Visit http://www.injuredworker.org/Senate.htm now and let them know your opposition to SJR 36.

It was sponsored by Senator ATKINSON at the request of Oregon Grocery Industry Association. He is out of Grants Pass. His site is at http://www.leg.state.or.us/atkinson/home.htm and has an e-mail link. You'd be better off sending an e-mail or calling your own senator who has to at least listen to you since you vote in their district. Atkinson does deserve anger for doing this.
