Long story made short, I was hurt at work, doctor said I would be fine.....no problem but after months of seeing this Dr. I was still not fine. Any how, seen another doctor and because of the damage and lack of care I had to have my arm amputated. I have finally been offered a settlement from the first doctor and hospital due to the sub-standard care. Will the W/C carrier want some of this money to cover their costs paid to this doctor? So far nothing has been said about this, lawyer doesn't seem to think they will, has anyone ever experienced this?

Not knowing what state you are in makes it difficult to really address your question. If the workers compensation carrier had to pay the medical as a result of the malpractice then it is likely then will want a portion of the settlement.

i'm not familiar with malpractice at all but my case invoved a third party lawsuit wich i won in pa. upon my settlement of my award workman's comp reclaimed every penny they had paid out. after my many months in the hospital then in rehab their total costs were just over 1.6 million dollars and their portion comes right off the top of any settelement in that state!
