This is why we are losing the battle. Hear are some of the answer we have receive from attorney since April-1997 to Sept.1999. Hear are just a few. "Can't help " Your to close to home" "Call after referee's decision Called later for appeal,not much we can do" System has problems, not interested", No response" " your locked into the system" Can't get screwed,if I present this before referee, I don't want to screw things up" Cannot jeopardize myself, have a wife and two kids" Will not jeopardize other cases of Workers'Comp. for one case" I don't want to do, I have other cases to consider" $5,000 min.deposit, They do not pay till eve of case" Contact your state Rep."your concern is really a political one at this point. Case has mereits" After hearing case to busy. "do not want to get involed, look out side the area."This man has been fighting this case for 15 years. Posted At 14:01:12 01/18/2000 The problem is just as bad here in Oregon Too!. The Workers comp carriers make damn sure that your attorney recieves little for his or her time, It is a way for the carriers to punish these attorneys for accepting your case, Even though if you lose you case the Carriers pay their attorneys thousands in bonus money for saving them from the amount of compensation. The attorney that represented my case was paid $150 for his time, and they refused to pay his travel expenses to court, That bill was up to me to pay. That is how these companies want it. I had to sit and listen to an obviously drunk Administrative Law Judge who could't remember what either attorney was saying He kept asking for them to repeat themselves. My attorney asked the judge if he was feeling alright and we had to listen to the Judge chew my attorney out because in his mind he felt that my attorney was questioning his compentancy in handling what was presented to him. Even the parasite W/C attorney made a comment about his ability to handle this case. I have a feeling that if the Oregon State Supreme court rules in favor of smothers that all of the attorneys that have been excluded from proper compensation for handling Injured workers cases will make their servises know. Their is no money to be made for private attorneys, Oregon state has saw to that. What a wonderful state of affairs for a State to keep Injured workers or anyone from recieving their right to due process. When I think about how the State of Oregon treats its citizens, I am reminded of Germany of the 30's and 40's. |

Posted At 02:43:56 02/23/2000 MY HUSBAND WAS HURT AT WORK, WE FOUGHT WITH L&I FOR OVER 2 YEARS BEFORE WE BROKE DOWN AND GOT AN ATTORNEY. HE WROTE 2 LETTERS, ONE TO REQUEST A COPY OF THE FILE, AND ONE TO SAY HE HAD READ IT, THE CLAIM WAS COMPENSABLE AND REQUEST PAYMENT. HE RECEIVED JUST UNDER $10,000.00 FOR HIS TROUBLE. HE WOULD HAVE GOTTEN $20,000.00 BUT AGREED TO RELEASE THE PPD AWARDED IN FULL IN THE INTEREST OF "A FAIR FEE FOR SERVICES RENDERED", AND ONLY AFTER WE APPROACHED HIM WITH THE PROPOSITION. THIS ATTORNEY NEVER SENT THE DEPARTMENT ANY ADDITIONAL INFORMATION, OR DOCUMENTATION OF ANY TYPE. HE NEVER CHECKED TO SEE IF THE AMOUNT OF TIME LOSS THEY PAID WAS ACCURATE (IT WAS NOT). HE NEVER CORRECTED THE MISTAKE IN THE NUMBER OF DEPENDENTS THEY HAD LISTED, WHICH WAS 2 INSTEAD OF THE 4 WE ACTUALLY HAD AT THE TIME OF THE ACCIDENT. THE ATTORNEYS SEEM TO BE A PART OF THE PROBLEM IN WASHINGTON, THEY ALL WANT 30% OF ANY BENEFITS RECOVERED, THAT IS 30% OF THE 65% OF YOUR ACTUAL LOST WAGES IF YOUR SINGLE WITH NO DEPENDENTS. A SPOUSE ADDS 5% AND EACH DEPENDENT ADDS 2%...WHY SHOULD AN ATTORNEY AUTOMATICALLY GET 30% OF IT NO MATTER HOW MUCH WORK IS DONE TO EXTRACT IT FROM L&I. IT DOESN'T ALWAYS TURN OUT THAT THEY EARN WHAT THEY GET. |

HE FAILED TO PROPERLY ARGUE THE CLOSING OF THE CLAIM. IT SHOULD NOT HAVE BEEN CLOSED, NOT ALL THE INJURIES THEY ACCEPTED HAD BEEN TREATED, HE NEVER MENTIONED THAT FACT WHEN HE PROTESTED THE CLOSING. IT TOOK US ALMOST A YEAR TO GET THE CLAIMS CLOSURE REVERSED ON OUR OWN, AND NOW AFTER 9 MORE MONTHS OF DELAYS AND DEPARTMENTAL B.S., MY HUSBAND FINALLY HAS A SURGERY DATE SCHEDUALED. THE ATTORNEYS SEEM TO BE A PART OF THE PROBLEM IN WASHINGTON, ALMOST AS THOUGH THERE IS SOME TYPE OF AGREEMENT BETWEEN THEM AND L&I. THEY ALL WANT 30% OF ANY BENEFITS RECOVERED, THAT IS 30% OF THE 60% OF YOUR ACTUAL LOST WAGES YOU WILL GET IF YOUR SINGLE WITH NO DEPENDENTS, THAT LEAVES YOU WITH 30% OF WHAT YOU WERE EARNING WHEN YOU GOT HURT.
